Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Matthew Kinley, trading as RenoViewer (“RenoViewer”, “we”, “us”) governing your access to and use of the RenoViewer website and services. By creating an account or using the service, you agree to these Terms.

1. The service

RenoViewerlets real estate agents (“Agents”) add property listings and lets prospective buyers (“Buyers”) generate AI renovation previews (“Renders”) of rooms in those listings. We may change, suspend, or discontinue features at any time.

2. Accounts

  • You must provide accurate information and keep your account credentials secure.
  • You are responsible for all activity that occurs under your account.
  • You must be authorised to advertise any property you add to the service.

3. AI renders — important disclaimer

Renders are AI-generated, conceptual illustrations only. They are provided for inspiration and visualisation, and they are not:

  • an accurate representation of the actual property or its current condition;
  • a guarantee that any renovation, finish, or design shown can be achieved, or achieved at a particular cost;
  • advice on structural feasibility, building code, resource/building consent, or other regulatory compliance;
  • a valuation, inspection, or professional design service.

Buyers should not rely on Renders when making a purchasing decision and should obtain independent professional advice. Agents are responsible for ensuring their use of Renders complies with applicable real estate advertising and fair-trading laws.

4. Content and intellectual property

  • You retain ownership of the property photos and content you upload.
  • By uploading content, you grant RenoViewer a licence to host, process, and use it to provide the service (including generating Renders).
  • You must have the rights to any content you upload and must not upload unlawful, infringing, or offensive material.
  • We own the RenoViewer platform, branding, and software. These Terms do not transfer any of our intellectual property to you.

5. Acceptable use

You agree not to:

  • use the service for any unlawful purpose or in breach of these Terms;
  • upload content you do not have the right to use, or that is misleading, offensive, or infringes others' rights;
  • attempt to disrupt, reverse engineer, or gain unauthorised access to the service;
  • use the service to generate content that is harmful, deceptive, or violates others' privacy.

6. Pricing, billing, and taxes

  • Pricing is shown on our pricing page and may vary by region. The price shown is the total amount payable. We are not currently registered for GST, so no GST is added; if that changes, any GST will be shown separately at checkout.
  • Listing setup fees and render packs are one-time charges. There is no subscription.
  • Payments are processed by Stripe. By paying, you also agree to Stripe's terms.
  • Fees are payable in the currency shown at checkout, based on your billing region.

7. Refunds

Refund terms are set out in our Refund Policy. Nothing in these Terms limits rights you may have under the New Zealand Consumer Guarantees Act 1993 or the Australian Consumer Law that cannot be excluded.

8. Privacy

Our handling of personal information is described in our Privacy Policy.

9. Disclaimers and limitation of liability

To the maximum extent permitted by law, the service is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential loss, or for loss arising from reliance on Renders. Our total liability in connection with the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded, including under the consumer laws referenced above.

10. Suspension and termination

We may suspend or terminate your access if you breach these Terms or to protect the service or other users. You may stop using the service at any time.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Continued use after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction over any dispute.
